Rental Agreement
Note: This is a template rental agreement. The final legal document must be reviewed by Texas counsel before launch.
1. Parties
This Rental Agreement ("Agreement") is entered into between Tote Palace ("Company") and the customer ("Renter") for the rental of reusable moving totes and related equipment.
2. Rental Terms
- Rental period begins on the scheduled delivery date and ends on the scheduled pickup date.
- Renter agrees to return all rented items in good condition, normal wear excepted.
- Extensions may be requested and are subject to availability and additional fees.
3. Payment and Deposit
- Renter agrees to pay the rental fee plus any applicable add-ons at the time of booking.
- A refundable security deposit is required and will be refunded upon successful return and inspection of all rented items.
- Deposit deductions may be applied for lost, damaged, or excessively soiled items.
4. Renter Responsibilities
- Renter is responsible for the care and safekeeping of all rented items during the rental period.
- Renter agrees to use totes only for their intended purpose (moving and storage of household items).
- Renter must make all items available for pickup at the scheduled date, time, and location.
- Renter must provide accurate contact information and delivery address.
5. Damage and Loss
- Renter is responsible for the replacement cost of any lost or irreparably damaged totes.
- Normal wear and tear is expected and will not result in deposit deductions.
- Company will inspect all returned items and notify Renter of any issues within 48 hours of pickup.
6. Cancellation and Rescheduling
- Cancellations made 48+ hours before delivery receive a full refund.
- Cancellations made less than 48 hours before delivery may be subject to a cancellation fee.
- Rescheduling is subject to availability and must be requested at least 24 hours in advance.
7. Service Area
Company provides delivery and pickup services within a 15-mile radius of Elgin, Texas. Addresses outside this area may be subject to additional fees or may not be serviceable.
8. Limitation of Liability
Company is not responsible for damage to Renter's property contained within the totes. Renter is solely responsible for properly packing and securing items.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.
10. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements relating to its subject matter.
